441 IPC In Hindi – आपराधिक अतिचार।
जो कोई अपराध करने के इरादे से या ऐसी संपत्ति के कब्जे वाले किसी भी व्यक्ति को धमकाने, अपमान करने या परेशान करने के इरादे से या किसी अन्य के कब्जे में संपत्ति में प्रवेश करता है, या कानूनी रूप से या ऐसी संपत्ति में प्रवेश करता है, गैरकानूनी रूप से वहां रहने के इरादे से रहता है किसी ऐसे व्यक्ति का अपमान या नाराज़ करना, या अपराध करने के इरादे से, “आपराधिक अतिचार” करने के लिए कहा जाता है।

धारा 441 के स्थान पर, निम्नलिखित धारा को प्रतिस्थापित किया जाएगा,
अर्थात्:- “441.
आपराधिक अतिचार।
जो कोई अपराध करने के इरादे से या ऐसी संपत्ति के कब्जे वाले किसी व्यक्ति को धमकाने, अपमान करने या परेशान करने के इरादे से किसी अन्य के कब्जे में संपत्ति में प्रवेश करता है, या, कानूनी रूप से या ऐसी संपत्ति में प्रवेश करके, गैरकानूनी रूप से वहां रहने के इरादे से रहता है जिससे डराना किसी ऐसे व्यक्ति का अपमान या नाराज़ करना या अपराध करने के इरादे से, या कानूनी रूप से ऐसी संपत्ति में प्रवेश करना या उस पर अनधिकृत कब्ज़ा लेने या ऐसी संपत्ति का अनधिकृत उपयोग करने के इरादे से वहाँ रहता है और ऐसी संपत्ति या उसके कब्जे को वापस लेने में विफल रहता है या उपयोग, जब किसी अन्य व्यक्ति द्वारा लिखित में नोटिस द्वारा ऐसा करने के लिए कहा जाता है, उस पर विधिवत तामील किया जाता है, तो कहा जाता है कि उसने “आपराधिक अतिचार” किया है। [1986 के उड़ीसा अधिनियम 22, धारा। 2 (प्रभावी 6-12-1986)]।
उतार प्रदेश।
धारा 441 के स्थान पर निम्नलिखित को प्रतिस्थापित करें:- “441.
आपराधिक अतिचार।
जो कोई भी अपराध करने के इरादे से या किसी अन्य व्यक्ति के कब्जे में संपत्ति में प्रवेश करता है या ऐसी संपत्ति के कब्जे वाले व्यक्ति को धमकाने, अपमान करने या परेशान करने के लिए, या कानूनी रूप से प्रवेश करता है या ऐसी संपत्ति पर अवैध रूप से रहता है जिससे डराने, अपमान करने का इरादा होता है या किसी ऐसे व्यक्ति को नाराज करना, या अपराध करने के इरादे से, या, ऐसी संपत्ति में प्रवेश करना या उस पर, चाहे आपराधिक कानून (यू.पी. संशोधन) अधिनियम, 1961 के लागू होने से पहले या बाद में, अनधिकृत रूप से लेने के इरादे से इस तरह की संपत्ति का कब्जा या अनधिकृत उपयोग ऐसी संपत्ति या इसके कब्जे या उपयोग से वापस लेने में विफल रहता है, जब किसी अन्य व्यक्ति द्वारा लिखित रूप में नोटिस द्वारा ऐसा करने के लिए कहा जाता है, नोटिस में निर्दिष्ट तिथि तक उसे विधिवत तामील किया जाता है, कहा जाता है “आपराधिक अपराध” करने के लिए।

IPC Section 441 – Criminal trespass.
Whoever enters into or upon property in the possession of another with intent to commit an offence or to intimidate, insult or annoy any person in possession of such property, or having lawfully entered into or upon such property, unlawfully remains there with intent thereby to intimidate, insult or annoy any such person, or with intent to commit an offence, is said to commit “criminal trespass”.
STATE AMENDMENT
Orissa
For section 441, the following section shall be substituted,
namely:— “441.
Criminal Trespass.
Whoever enters into or upon property in possession of another with intent to commit an offence or to intimidate, insult or annoy any person in possession of such property, or, having lawfully entered into or upon such property, unlawfully remains there with intent thereby to intimidate, insult or annoy any such person or with intent to commit an offence, or having lawfully entered into or upon such property, remains there with the intention of taking unauthorised possession or making unauthorised use of such property and fails to withdraw such property or its possession or use, when called upon to do so by that another person by notice in writing, duly served on him, is said to have commit “criminal trespass.“ [Vide Orissa Act 22 of 1986, sec. 2 (w.e.f. 6-12-1986)].
Uttar Pradesh.
For section 441, substitute the following:— “441.
Criminal Trespass.
Whoever enters into or upon property in possession of another with intent to commit an offence or to intimidate, insult or annoy and person in possession of such property, or having lawfully entered into or upon such property, unlawfully remains therewith intent thereby to intimidate, insult or annoy any such person, or with intent to commit an offence, or, having entered into or upon such property, whether before or after the coming into force of the Criminal Law (U.P. Amendment) Act, 1961, with the intention of taking unauthorised possession or making unauthorised use of such property fails to withdraw from such property or its possession or use, when called upon to do so by that another person by notice in writing, duly served upon him, by the date specified in the notice, is said to commit “criminal trespass”.
